These Terms of Service ("Terms") govern your use of the ManageMyStaffing application and related services ("Service"). By accessing or using the Service, you agree to these Terms.
The Service is intended for use by skilled-nursing-facility staff and administrators authorized by their employer. You may only access the Service via an account provisioned by your employer. You're responsible for safeguarding your credentials and for all activity under your account.
You agree not to:
The Service operates two distinct SMS programs. Both are transactional only — no marketing content. Carriers are not liable for any delayed or undelivered messages.
The Service sends SMS notifications to facility staff who have opted in via the SMS Consent step in the new-hire onboarding paperwork (a self-service, optional step with a default-unchecked checkbox; opting in requires entering a valid US mobile number and signing on-screen). Content is limited to open shifts, schedule changes, time-off responses, and HR communications. Adding or editing an employee in the admin modal does not enroll the employee in SMS and does not grant any SMS consent.
The Service sends post-discharge follow-up SMS to patients of contracted facilities who have signed the paper consent form (Form MMS-SMS-CONSENT v1.0) at intake. Content is limited to appointment reminders, medication reminders, and brief recovery check-in surveys, sent on behalf of the discharging facility. Patient consent is voluntary and is not a condition of receiving care.
Your employer (the facility) owns the data they enter or that's generated through their use of the Service. ManageMyStaffing processes this data on the facility's behalf. We do not claim ownership of customer data.
We aim for high availability but the Service is provided "as is" without warranty of uninterrupted operation. Scheduled maintenance is announced in advance. Critical security patches may be applied without prior notice.
The Service is designed to support CMS PBJ reporting and standard wage-and-hour compliance. You and your employer are responsible for ensuring data entered into the Service is accurate, that you've obtained necessary consents, and that your use of the data complies with applicable law (FLSA, state employment laws, etc.).
Your employer may terminate your account at any time. We may suspend or terminate accounts that violate these Terms. Upon termination, your access ends but data is retained per the Privacy Policy.
To the maximum extent permitted by law, ManageMyStaffing's total liability for any claim arising from the Service is limited to the fees paid by your employer for the Service in the 12 months preceding the claim. We're not liable for indirect, incidental, or consequential damages, including lost profits or lost data.
You agree to indemnify ManageMyStaffing for claims arising from your violation of these Terms or your misuse of the Service.
We may update these Terms. Material changes will be notified to your facility's administrators. Continued use after changes constitutes acceptance.
These Terms are governed by the laws of the state of Texas, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Texas.
